Terms and Conditions of Contest Detailed below are the Terms and Conditions of the Car Rental Express Rate and Win!™ Contest. Briefly, it is a recurring monthly draw for the value of a recent car rental up to a value of US $1000 for those who have been invited to utilize the Car Rental Express Consumer Reliability Index™ to rate a recent member agency car rental experience, and who meet the terms and conditions listed below.
 Contest officially starts at 12:01 AM (Pacific Daylight Time) on 12/15/03 and continues until a 60 day notification of its ending is posted on http://www.carrentalexpress.com and http://www.carrentalexpress.net The Sponsor of this contest is Car Rental Express.Com Inc. The contest shall be subject to these Official Rules, and by entering, all participants agree to be bound by the terms and conditions herein. Certain restrictions may apply. A new draw will take place on the first business day following each month end until 60 days notice of the contest ceasing is posted. The contest will continue through the 60 day notice period. 2. ELIGIBILITY: This Contest is open to those who have made a car rental reservation through http://www.carrentalexpress.com, and have completed the transaction by renting a vehicle from the car rental agency with which the reservation was made. This rental may only be used once for the purpose of entering the contest. As well a customer who does not reserve through CRX but wishes to enter the contest and has rented a car through the agency being rated can enter the contest at the time the rental is being completed and the contract is being closed. The contest is also open to those that have rented within the last year from one of the agencies listed on Car Rental Express.The contest is not open to the officers, directors, employees, contractors, and agents of the Sponsor or of the car rental agencies listed on http://www.carrentalexpress.com. As well the immediate family members of those listed above are not eligible. All federal, provincial and local rules and regulations apply. Void where prohibited or restricted by law. 3. HOW TO ENTER: You will automatically be entered by responding to and completing the rating survey email sent to you at the email address given by you at the time of making a reservation on http://www.carrentalexpress.com. The email will be sent to you the day after the scheduled drop off date of the car rental reservation. This email will ask you to complete the survey based on your rental experience with the particular rental agency. You can enter the contest by responding to the email sent to you by one of the agencies listed on Car Rental Express, or you may also enter by rating one of the agencies listed on Car Rental Express. This is done by following the links on the homepage of http://www.carrentalexpress.com . 4. WINNER SELECTION: The monthly winner will be selected in a random drawing from all eligible entries on or about the first business day after the month end from all the survey response emails received during the previous month. The monthly prize winner will be notified by phone, email, or regular mail. Each monthly winner will required to execute and return a Publicity Release form within 3 days of issuance. Failure to comply with this provision may result in the winner being disqualified and an alternate winner selected. If a prize notification or a prize is returned as undeliverable for any reason, the applicable prize will be awarded to an alternate winner. Prizes are not transferable or assignable. All Federal, provincial, local or other tax liabilities are the sole responsibility of the winners. Acceptance of a prize constitutes permission (except where prohibited by law) to use the winner's name, address (city and province only), photograph, likeness and statements for advertising, promotional or publicity purposes without additional compensation or limitation. The Sponsors and any and all Internet server(s) and access provider(s) (collectively, "Promotion Entities"), and each of their respective affiliates, subsidiaries, parent corporations and advertising and promotional agencies, and all of their officers, directors, shareholders, employees and agents (collectively, "Release’s") are not responsible for: any incorrect or inaccurate entry information; human errors; technical malfunctions; failures, omissions, interruptions, deletions or defects of any telephone network, computer online systems, computer equipment, servers, providers, or software, including without limitation any injury or damage to participant's or any other person's computer relating to or resulting from participation in the contest; inability to access the Entry Site; theft, tampering, destruction, or unauthorized access to, or alteration of, entries; data that is processed late or incorrectly or is incomplete or lost due to telephone, computer or electronic malfunction or traffic congestion on telephone lines or the Internet or any web site (including the Entry Site) or for any other reason whatsoever; printing or other errors; or any combination thereof. Proof of entering information at Entry Site is not considered proof of delivery or receipt. Illegible, incomplete, and duplicate entries will be disqualified. All entries become the property of the Sponsor and will not be acknowledged or returned. False, fraudulent or deceptive entries or acts shall render entrants ineligible. By entering the contest, entrants affirm that they have read and accepted these Official Rules. Any entry information collected from the contest shall be used only in a manner consistent with the consent given by entrants at the time of the entry, with these Official Rules. 5. PRIZES: The winning entry will be reimbursed the cost of her/his rental to which the survey refers to a maximum of $1000.00 US. The prize will be awarded monthly until the contest is over. The odds of winning a prize are determined by the total number of eligible entries received. Limit one (1) prize per person and per household. The prize is awarded as delivered. The prize will be paid by Car Rental Express company check or a credit card “credit” solely at the discretion of Car Rental Express.Com Inc. 6. GENERAL: Entrants release and waive any claim they may have against Releases and their respective employees, officers, directors, shareholders, affiliates, subsidiaries, parent and related companies, distributors, dealers and agencies and their respective successors and assigns for injuries, claims, damages or losses, costs or expenses of any kind resulting from acceptance of or possession of or arising out of use or misuse of a Prize or parts thereof or from participation in this Contest. If for any reason, this Contest is not capable of running as planned, or if this Contest or any web site associated therewith (or any portion thereof) becomes corrupted or does not allow the proper playing of the Contest and processing of entries in accordance with these rules, or if infection by computer virus, bugs, tampering, unauthorized intervention, actions by entrants, fraud, technical failures, or any other causes, in the Sponsor's sole opinion, corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Contest, The Sponsor reserves the right, at their sole discretion, to disqualify any individual implicated in such action and/or to cancel, terminate, modify, or suspend this Contest or any portion thereof. In the event this Contest is cancelled, the Sponsor reserves the right to conduct a random drawing to award all remaining prize from among all eligible, non-suspect on-line entries received prior to the time of the action or event warranting such cancellation. Any attempt by an entrant or any other individual to deliberately damage any web site or undermine the legitimate operation of the Contest is a violation of criminal and/or civil laws and should such an attempt be made, the Sponsor reserve the right to seek damages and other remedies from any such person to the fullest extent permitted by law. Where a dispute arises about who submitted an on-line entry, the entry will be deemed submitted by the authorized account holder of the e-mail account entered. The authorized account holder is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider, or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry and that all eligibility requirements are met. NOTE: Entries must be made by the entrant via email. The use of any device to automate the entry process is prohibited. 7. WINNER'S LIST INFORMATION: A copy of these Official Rules or the Official Winner's List (available after 12/31/03) is available during the Contest entry period at the Entry Site.
